1. About Ouchy
These Terms and Conditions ("Terms") govern your access to and use of Ouchy, an AI-powered conversational companion service operated by THB INFOTECH PRIVATE LIMITED, a company incorporated under the laws of India ("THB Infotech", "Ouchy", "we", "us", "our").
Registered entity: THB INFOTECH PRIVATE LIMITED.
Ouchy provides AI-generated conversational experiences through text chat and real-time voice interaction.
Ouchy is an artificial intelligence service. Ouchy is not a human being and does not represent a real person.
2. Eligibility — 18+ only
Ouchy is strictly intended for users who are at least 18 years old and legally permitted to access the service in their jurisdiction.
You may not register for, access, purchase or use Ouchy if you are under 18.
You represent that you are at least 18 years old and legally permitted to use an adult-oriented AI companion service in your jurisdiction.
We may require additional age verification where required by law, our payment providers, acquiring banks, or our risk and compliance systems. We reserve the right to suspend or terminate accounts where age information cannot be verified.
3. What Ouchy is
Ouchy is an AI-powered companion designed for:
- conversational interaction
- relationship-style conversations
- emotional and social interaction
- personalised character experiences
- text conversations
- real-time voice conversations
- memory and personalisation
- character customisation
Ouchy does not claim to be a human, a therapist, a medical professional, a financial adviser, a lawyer, an emergency service, or a substitute for professional healthcare or human relationships. AI responses may occasionally be inaccurate, unexpected, incomplete or inappropriate.
4. AI-generated content
Ouchy uses artificial intelligence to generate conversational responses. You acknowledge that:
- responses are generated automatically
- responses may vary between conversations
- Ouchy may make mistakes
- Ouchy may refuse certain requests
- Ouchy may change its response based on context
- no AI response should automatically be treated as factual advice
You are responsible for how you interpret and use AI-generated responses.
5. Adult content & content standards
Ouchy is an 18+ service. However, 18+ does not mean unrestricted content. You may not use Ouchy to generate, request, encourage or facilitate content involving:
- Minors, or persons represented as under 18, in any sexual context — zero tolerance
- Sexual exploitation of minors — zero tolerance
- Non-consensual sexual activity, rape or sexual assault — zero tolerance
- Sexual activity involving a person who is unconscious, incapacitated, drugged, intoxicated or otherwise unable to consent
- Incestuous sexual activity
- Sexual activity involving animals or non-human creatures
- Extreme sexual violence, graphic torture, mutilation or sexualised violence
- Trafficking or exploitation
- Sexual content involving real persons without appropriate rights or consent
- Impersonation intended to facilitate fraud, abuse, harassment or exploitation
- Hate-based or discriminatory content
- Illegal activity, or content designed to facilitate criminal activity
We may block, modify, refuse, report or terminate interactions that violate these requirements. The exact boundaries of permitted adult content may vary depending on jurisdiction, payment processor, acquiring bank, app marketplace and applicable law.
6. User inputs
You may communicate with Ouchy using text and voice. You must not intentionally submit:
- illegal content
- content involving minors
- another person's private information without authorisation
- stolen copyrighted material
- malicious code
- credentials or authentication secrets
- content intended to circumvent our safety systems
- content intended to cause Ouchy to generate prohibited material
7. Voice conversations
Ouchy may process:
- microphone input
- speech-to-text transcription
- AI-generated responses
- text-to-speech audio
- technical metadata associated with a voice session
Voice functionality may require third-party technology providers. Voice conversations may be processed in real time to provide the service, enforce safety controls, maintain security and improve reliability, subject to the Privacy Policy and applicable law. Where recording or storage is enabled, Ouchy will provide an appropriate disclosure and consent mechanism.
8. Memory
Ouchy may offer memory functionality. Depending on your settings and the features you use, Ouchy may remember information you intentionally provide to improve future conversations — for example your preferred name, conversational preferences, character preferences, interests, relationship preferences and previous conversational context.
You can manage or delete available memories through your account where the relevant functionality is provided.
Do not intentionally provide highly sensitive information such as passwords, financial credentials, government identification numbers or confidential authentication information.
9. User content
You retain your rights in content you submit, subject to rights necessary for us to operate Ouchy.
You grant THB Infotech a limited, worldwide, non-exclusive licence to host, store, process, reproduce and technically modify your content only as reasonably necessary to provide, secure, maintain and improve the Services, comply with law, and enforce these Terms.
We do not claim ownership of your personal conversations merely because you use Ouchy.
10. AI outputs
AI-generated content is produced by our systems in response to your interaction. You may use AI-generated outputs for lawful personal purposes subject to these Terms, third-party model/provider terms, applicable law and the intellectual property rights of others.
We do not guarantee that every AI-generated output is unique or free from third-party rights.
11. Payments & subscriptions
Ouchy may offer free access, monthly subscriptions that include a voice-minute allowance, additional voice-time purchases and other paid features. Prices are displayed before purchase.
Paid subscriptions may automatically renew unless cancelled before the applicable renewal date.
Your payment may be processed by an authorised third-party payment processor, which may appear on your billing statement. For the initial Ouchy launch the intended payment processor is PayFirmly, subject to merchant approval. If the payment provider changes, the applicable processor will be identified during checkout or in the applicable billing documentation.
12. Voice minutes
Voice conversation time is the paid usage unit in Ouchy. One voice minute equals one minute of voice conversation. Usage is measured in seconds and displayed to you in minutes.
Before purchasing you will be shown the number of voice minutes, the price, whether the charge is recurring, whether the minutes expire and whether they are refundable.
Monthly plan minutes reset at each renewal and do not carry over. Separately purchased voice minutes remain on your account and are used after your monthly allowance is exhausted.
13. Refund policy
Paid subscriptions and voice-time purchases are subject to the Ouchy Refund & Cancellation Policy, which is shown before payment is completed. Where legally required, consumers retain statutory cancellation and refund rights. Where a refund is approved, unused voice minutes or service access may be adjusted where permitted by law.
14. Cancellation
You may cancel recurring subscriptions through the account billing interface or the applicable payment-provider mechanism. Cancellation generally stops future renewal and does not automatically refund the current billing period unless required by law or otherwise approved under our Refund Policy.
15. Suspension & termination
We may suspend or terminate an account if:
- the user violates these Terms
- the user attempts to circumvent safety controls
- the user provides false age information
- the account creates payment or fraud risk
- required by law
- required by a payment provider or acquiring bank
- the account is involved in prohibited activity
- continued access creates a security or safety risk
16. Intellectual property
Ouchy — including its software, brand, logo, user interface, design, technology, underlying models, databases, systems, trademarks and documentation — is owned by or licensed to THB Infotech and is protected by applicable intellectual property laws. The Ouchy name and logo may not be copied or commercially exploited without permission.
17. Third-party services
Ouchy may rely on third-party providers including:
- cloud hosting
- AI model providers
- speech recognition
- text-to-speech
- realtime communications
- analytics
- fraud prevention
- age verification
- payment processing
- customer support
Those providers may process information as necessary to provide their services.
18. No guarantee of availability
We aim to provide reliable service but do not guarantee uninterrupted availability, zero latency, zero errors, uninterrupted voice calls, or the permanent availability of any model or feature. AI models and technical providers may change over time.
19. Limitation of liability
To the maximum extent permitted by applicable law, THB Infotech will not be liable for indirect, incidental, consequential, special or punitive damages arising from your use of Ouchy. Nothing in these Terms excludes liability that cannot legally be excluded.
20. Governing law
These Terms are governed by applicable Indian law, subject to mandatory consumer-protection and other laws that may apply to users in their jurisdiction.
